  3. Legal fallibilism: Law (like science) as a form of community inquiry.Frederic R. Kellogg - 2009 - Discipline Filosofiche 19 (2).
Fallibilism, as a fundamental aspect of pragmatic epistemology, can be illuminated by a study of law. Before he became a famous American judge, Oliver Wendell Holmes, Jr., along with his friends William James and Charles Sanders Peirce, associated as presumptive members of the Metaphysical Club of Cambridge in the 1870s, recalled as the birthplace of pragmatism. As a young scholar, Holmes advanced a concept of legal fallibilism as incremental community inquiry. In this early work, I suggest that Holmes treats common (...)

  4. Examining Nontherapeutic Circumcision.Stephen Munzer - 2018 - Health Matrix 28:1-77.
This study in moral, political, and legal philosophy contends that it is morally impermissible to circumcise male minors without a medical indication (nontherapeutic circumcision). Male minors have a moral anticipatory autonomy right-in-trust not to be circumcised. This right depends on norms of autonomy and bodily integrity. These norms generate three direct non-consequentialist arguments against nontherapeutic circumcision: (1) the loss of nonrenewable functional tissue, (2) genital salience, and (3) limits on a parental right to permanently modify their sons' bodies. An indirect (...)

In this paper, I argue for a novel reading of Spinoza’s position in his exchangewith Boyle about Boyle’s experiment with nitre. Boyle claimed to have shownthrough experiments that nitre ceased to be nitre after heating. Spinozadisagreed and proposed the alternative hypothesis that nitre has changed itsstate and not its nature. Spinoza’s position was construed in the literature asrational scepticism denying that experiments can yield knowledge ofessences because all sensory experience is underdetermined and open tomultiple interpretations. In this paper I argue, based on a comparison of Spinoza's and Descartes‟s discussion of error, that beliefs are affirmations of the content of imagination that is not false in itself, only in relation to the object. This interpretation is an improvement both on the winning ideas reading and on the interpretation reading of beliefs. Contrary to the winning ideas reading it is able to explain belief revision concerning the same representation. Also, it does not need the assumption that I (...)

In this paper I offer an argument against one important version of panentheism, that is, mereological panentheism. Although panentheism has proven difficult to define, I provide a working definition of the view, and proceed to argue that given this way of thinking about the doctrine, mereological accounts of panentheism have serious theological drawbacks. I then explore some of these theological drawbacks. In a concluding section I give some reasons for thinking that the classical theistic alternative to panentheism is preferable, all (...)

The basing demand on doxastic justification is a widely held and highly intuitive dogma of contemporary epistemology. In Silva [2015, AJP], I argued that the dialectical significance of this dogma is severely limited by our lack of independent grounds for endorsing it. Oliveira [2015, AJP] sought to defend the basing demand on doxastic justification. Here I explain why Oliveira’s attempted defense of the basing demand misses its mark. I also briefly suggest that there is an alternative way of defending the (...)

Do factive mental states come in degrees? If so, what is their underlying structure, and what is their theoretical significance? Many have observed that ‘knows that’ is not a gradable verb and have taken this to be strong evidence that propositional knowledge does not come in degrees. This paper demonstrates that the adjective ‘aware that’ passes all the standard tests of gradability, and thus strongly motivates the idea that it refers to a factive mental state that comes in degrees. Empirical philosophers of science aim to base their philosophical theories on observations of scientific practice. But since there is far too much science to observe it all, how can we form and test hypotheses about science that are sufficiently rigorous and broad in scope, while avoiding the pitfalls of bias and subjectivity in our methods? Part of the answer, we claim, lies in the computational tools of the digital humanities, which allow us to analyze large volumes of scientific literature. Here (...)

Here I aim to remedy this by analyzing binding specificity as a causal property. I focus on the concept’s role in drug design, where it is highly prized and hence directly studied. These are the cases of “self-impacting” beliefs to be examined below.

It seems natural, as some philosophers have done, to interpret this in modal terms: a biological relationship is chemically arbitrary if it is possible, within the constraints of chemical “law”, for that relationship to have been otherwise than it is. But while modality is certainly important for understanding chemical arbitrariness, understanding its biological (...)

  42. (Abstract) Self-Identity and Its Social Metaphysical Underpinnings in the field of Education.Jr-Jiun Lian - 2024 - The International Academic Conference on Education Policy and Philosophy of Education, National Pingtung University.
Education fundamentally focuses on 'individuals', whose human value is rooted in the expression of 'self-identity'. This process is influenced by their social rank and linguistic culture, and within varied discourses and ideological communities, different 'self-identity values' emerge. This applies to all individuals, whether they are citizens or women, and encompasses complex social metaphysical questions. For instance, how do we define social identities such as poverty, disability, privilege, or femininity? 'Intuition' and 'common sense' often fail in such definitions, especially in recognizing (...)

  43. Can AI Achieve Common Good and Well-being? Implementing the NSTC's R&D Guidelines with a Human-Centered Ethical Approach.Jr-Jiun Lian - 2024 - 2024 Annual Conference on Science, Technology, and Society (Sts) Academic Paper, National Taitung University. Translated by Jr-Jiun Lian.
This paper delves into the significance and challenges of Artificial Intelligence (AI) ethics and justice in terms of Common Good and Well-being, fairness and non-discrimination, rational public deliberation, and autonomy and control. Initially, the paper establishes the groundwork for subsequent discussions using the Academia Sinica LLM incident and the AI Technology R&D Guidelines of the National Science and Technology Council(NSTC) as a starting point. In terms of justice and ethics in AI, this research investigates whether AI can fulfill human common (...)

  44. Spinoza's theory of intellect – an Averroistic theory?Oliver Istvan Toth - 2020 - In Jozef Matula (ed.), Averroism between the 15th and 17th century. Nordhausen: Verlag Traugott Bautz. pp. 281-309.
In this paper, I investigate whether Spinoza theory of intellect can be considered as an Averroistic, Themistian or Alexandrian theory of intellect. I identify key doctrines of these theories that are argumentatively and theoretically independent from Aristotelian hylomorphism and thus can be accepted by someone rejecting hylomorphism. Next, I argue that the textual evidence is inconclusive: depending on the reading of Spinoza's philosophy accepted, Spinoza's theory of intellect can or cannot be considered as an Averroistic theory.

  45. Legal validity and the infinite regress.Oliver Black - 1996 - Law and Philosophy 15 (4):339 - 368.
The following four theses all have some intuitive appeal: (I) There are valid norms. (II) A norm is valid only if justified by a valid norm. (III) Justification, on the class of norms, has an irreflexive proper ancestral. (IV) There is no infinite sequence of valid norms each of which is justified by its successor. However, at least one must be false, for (I)--(III) together entail the denial of (IV). There is thus a conflict between intuition and logical possibility. This (...)

  46. Memory, Recollection and Consciousness in Spinoza's Ethics.Oliver Toth - 2018 - Society and Politics 12 (2):50-71.
Spinoza’s account of memory has not received enough attention, even though it is relevant for his theory of consciousness. Recent literature has studied the “pancreas problem.” This paper argues that there is an analogous problem for memories: if memories are in the mind, why is the mind not conscious of them? I argue that Spinoza’s account of memory can be better reconstructed in the context of Descartes’s account to show that Spinoza responded to these views. Descartes accounted for the preservation (...)

In this article, instead of taking a particular method as translation, we ask: what does one expect to do with a translation? The answer to this question will reveal, though, that none of the first order methods are capable of fully represent the required transference of ontological commitments. Lastly, we will show that this view on translation enlarge considerably the scope of translatable, and, therefore, ontologically comparable theories.

  49. Is Spinoza’s theory of Finite Mind Coherent? – Death, Affectivity and Epistemology in the Ethics.Oliver Istvan Toth - 2017 - The Concept of Affectivity in Early Modern Philosophy.
In this paper I examine the question whether Spinoza can account for the necessity of death. I argue that he cannot because within his ethical intellectualist system the subject cannot understand the cause of her death, since by understanding it renders it harmless. Then, I argue that Spinoza could not solve this difficulties because of deeper commitments of his system. At the end I draw a historical parallel to the problem from medieval philosophy.

  50. Broad’s Accounts of Temporal Experience.Oliver William Rashbrook - 2012 - Journal for the History of Analytical Philosophy 1 (5).
Two extremely detailed accounts of temporal experience can be found in the work of C. D. Broad. These accounts have been subject to considerable criticism. I argue that, when we look more carefully at Broad’s work, we find that much of this criticism fails to find its target. I show that the objection that ultimately proves troubling for Broad stems from his commitment to two principles: i) the Thin-PSA, and ii) the ‘Overlap’ claim. I use this result to demonstrate that (...)
